Gizlilik Politikası

1. Kapsam ve Veri Sorumlusu

Bu Gizlilik Politikası, Kinestos mobil uygulaması (Android paket adı: com.kinestos.kinestos, iOS paket kimliği: com.kinestos.app) ve kinestos.com web sitesi için geçerlidir. Kişisel verilerinizi 6698 sayılı Kişisel Verilerin Korunması Kanunu (KVKK) ve uygulanabildiği ölçüde AB Genel Veri Koruma Tüzüğü (GDPR) ile uyumlu biçimde işleriz.

2. Toplanan Veriler

2.1 Hesap bilgileri

• Google ile giriş: Google hesabınızın adı, e-posta adresi, profil fotoğrafı bağlantısı ve Google hesap kimliği. Şifrenizi hiçbir zaman görmeyiz.
• Apple ile giriş (yalnızca iOS): Apple'ın paylaşmayı seçtiğiniz ad ve e-posta (gizlenmiş e-posta olabilir).
• Cihaz özeti: Ücretsiz başlangıç kredilerinin kötüye kullanılmasını önlemek için cihaz tanımlayıcısının tek yönlü, tuzlanmış SHA-256 özeti. Ham tanımlayıcı cihazınızdan çıkmaz; reklam kimliği kullanılmaz.

2.2 Sizin sağladığınız içerik

• Fotoğraflar: Analiz için kendi isteğinizle çektiğiniz veya yüklediğiniz sağ/sol el, yüz ve (partner uyumu için) partner yüz fotoğrafları.
• Analiz sonuçları: Yapay zeka tarafından üretilen yorumlar ve bunlarla ilişkili görsel kayıtları.
• Test verileri: IQ testi ve diğer testlerdeki yanıtlarınız ve sonuçlarınız.
• Sohbetler: AI sohbete yazdığınız mesajlar ve verilen yanıtlar.
• İsteğe bağlı profil bilgileri: Bazı kapsamlı analizlerde kendi isteğinizle girdiğiniz ad, cinsiyet, doğum tarihi/saati/yeri gibi bilgiler.

2.3 Satın alma ve teknik veriler

• Satın almalar: Google Play'in (Android) veya Apple App Store'un (iOS) ilettiği satın alma doğrulama bilgileri (ürün kimliği, satın alma/işlem kimliği, abonelik durumu), kredi bakiyeniz ve kredi hareketleriniz. Kart veya ödeme bilgileriniz bize ulaşmaz.
• Teknik kayıtlar: Güvenlik, hata ayıklama ve kötüye kullanımı önleme amacıyla sunucu kayıtları (IP adresi, istek zamanı, hata kayıtları) ve yapay zeka kullanım kayıtları (ör. işlenen token sayısı).

3. Fotoğraflar ve Yapay Zeka İşleme

Bir analiz başlattığınızda seçtiğiniz fotoğraflar şifreli bağlantı (HTTPS) ile sunucumuza (backend.kinestos.com) yüklenir ve yorum üretilmesi için Google Gemini API'ye gönderilir. Sunucumuzda çalışan görüntü işleme bileşeni, sonuç ekranında gösterilen işaretli görselleri (ör. el çizgileri) oluşturabilir.

• Fotoğraflar ve analiz sonuçları, analiz geçmişinizi gösterebilmemiz için hesabınızda saklanır.
• Fotoğraflarınız biyometrik tanımlama, yüz tanıma veritabanı oluşturma veya kimlik doğrulama için kullanılmaz.
• Fotoğraflarınız ve sonuçlarınız satılmaz, reklam amacıyla kullanılmaz veya üçüncü kişilerle paylaşılmaz (aşağıdaki hizmet sağlayıcılar hariç).
• Partner uyumu için başka bir kişinin fotoğrafını yüklüyorsanız, o kişinin iznini almış olmanız gerekir.

4. Verilerin Kullanım Amaçları

• Hesabınızı oluşturmak, oturumunuzu yönetmek ve kimliğinizi doğrulamak
• İstediğiniz analizleri, testleri ve sohbet yanıtlarını üretmek ve geçmişinizde göstermek
• Satın alımları doğrulamak, kredi bakiyenizi ve aboneliğinizi yönetmek
• Hizmetin güvenliğini sağlamak, kötüye kullanımı ve dolandırıcılığı önlemek
• Destek taleplerinize yanıt vermek ve yasal yükümlülükleri yerine getirmek

Hukuki sebepler (KVKK m.5): sözleşmenin kurulması ve ifası, hukuki yükümlülük, meşru menfaat (güvenlik ve kötüye kullanımın önlenmesi) ve fotoğraf yükleme gibi işlemlerde açık rızanız.

5. Paylaşım ve Hizmet Sağlayıcılar

Verilerinizi satmayız. Yalnızca hizmeti sunmak için gereken ölçüde aşağıdaki hizmet sağlayıcılarla paylaşırız:

Google hizmetleri verileri Türkiye dışındaki sunucularda işleyebilir; bu aktarım hizmetin sunulması için gereklidir. Yasal olarak zorunlu olduğu durumlarda yetkili makamlarla da paylaşım yapılabilir.

6. Saklama ve Silme

• Verileriniz hesabınız açık olduğu sürece saklanır.
• Hesabınızı sildiğinizde hesabınız, analizleriniz, fotoğraflarınız, sohbetleriniz, test sonuçlarınız ve kredi geçmişiniz silinir; yedeklerdeki kopyalar dahil işlem en geç 30 gün içinde tamamlanır.
• Kötüye kullanımı önlemek için cihaz özeti ve başlangıç kredisinin verildiği tarih, hesabınızla ilişkisi kesilmiş olarak saklanabilir.
• Ödeme kayıtları Google Play (Android) veya Apple (iOS) tarafından kendi politikalarına göre saklanır.

7. Güvenlik

• Uygulama ile sunucu arasındaki tüm iletişim TLS (HTTPS) ile şifrelenir.
• Oturum anahtarları cihazınızda güvenli depolama (Android Keystore / iOS Keychain) ile saklanır.
• Sunucu ve veritabanına erişim yetkili kişilerle sınırlıdır.

Hiçbir sistem %100 güvenli değildir; bir güvenlik ihlali olması halinde yasal yükümlülüklerimiz çerçevesinde sizi ve ilgili makamları bilgilendiririz.

8. Haklarınız

KVKK'nın 11. maddesi ve GDPR kapsamında; verilerinizin işlenip işlenmediğini öğrenme, bilgi ve kopya talep etme, düzeltme, silme, işlemeye itiraz etme, verilerinizin aktarılmasını isteme ve açık rızanızı geri çekme haklarına sahipsiniz.

Taleplerinizi hesabınızda kayıtlı e-posta adresinden aybuahdevefa@gmail.com adresine iletebilirsiniz. Talepler en geç 30 gün içinde yanıtlanır. Ayrıca Kişisel Verileri Koruma Kurumu'na veya bulunduğunuz ülkenin veri koruma otoritesine şikâyette bulunma hakkınız vardır.

9. Yaş Sınırı

Kinestos 18 yaş altındaki kişilere yönelik değildir ve bilerek 18 yaş altındaki kişilerden veri toplamayız. 18 yaşından küçük bir kişinin uygulamayı kullandığını fark edersek ilgili hesabı ve verileri sileriz. Böyle bir durumu bize bildirebilirsiniz.

10. Web Sitesi ve Çerezler

kinestos.com web sitesinde hesap oluşturulmaz, iletişim formu, analitik veya reklam aracı yoktur ve çerez kullanılmaz. Yalnızca dil tercihiniz tarayıcınızın yerel depolamasında (localStorage) tutulur. Sunucu, güvenlik amacıyla standart erişim kayıtları (IP adresi, tarayıcı bilgisi, zaman) tutar. Yazı tipleri Google Fonts üzerinden yüklenir; bu sırada IP adresiniz Google'a iletilir.

11. Değişiklikler ve İletişim

Bu politikayı gerektiğinde güncelleyebiliriz. Güncel sürüm her zaman bu sayfada yayımlanır; önemli değişiklikleri uygulama içinde duyururuz.

1. Scope and Data Controller

This Privacy Policy applies to the Kinestos mobile app (Android package name: com.kinestos.kinestos, iOS bundle ID: com.kinestos.app) and the kinestos.com website. We process personal data in line with the Turkish Personal Data Protection Law No. 6698 (KVKK) and, where applicable, the EU General Data Protection Regulation (GDPR).

2. Data We Collect

2.1 Account data

• Sign in with Google: your Google account name, email address, profile photo URL and Google account ID. We never see your password.
• Sign in with Apple (iOS only): the name and email you choose to share via Apple (this may be a private relay address).
• Device digest: a one-way, salted SHA-256 digest of a device identifier, used to prevent abuse of free starter credits. The raw identifier never leaves your device; no advertising ID is used.

2.2 Content you provide

• Photos: right/left hand, face and (for partner compatibility) partner face photos that you choose to take or upload for an analysis.
• Analysis results: AI-generated readings and the related image records.
• Test data: your answers and results in the IQ test and other tests.
• Chats: messages you write in AI chat and the replies.
• Optional profile details: details such as name, gender, date/time/place of birth that you choose to enter for some comprehensive analyses.

2.3 Purchase and technical data

• Purchases: purchase verification data sent by Google Play (Android) or the Apple App Store (iOS) (product ID, purchase token / transaction ID, subscription status), your credit balance and credit transactions. Your card or payment details never reach us.
• Technical logs: server logs (IP address, request time, error logs) for security, debugging and abuse prevention, and AI usage logs (e.g. number of tokens processed).

3. Photos and AI Processing

When you start an analysis, the photos you select are uploaded over an encrypted connection (HTTPS) to our server (backend.kinestos.com) and sent to the Google Gemini API to generate the reading. An image-processing component running on our server may create the annotated images shown on the result screen (e.g. palm lines).

• Photos and analysis results are stored in your account so we can show your analysis history.
• Your photos are never used for biometric identification, building face-recognition databases or authentication.
• Your photos and results are not sold, not used for advertising and not shared with third parties (except the service providers listed below).
• If you upload another person's photo for partner compatibility, you must have that person's permission.

4. How We Use Data

• To create your account, manage your session and authenticate you
• To generate the analyses, tests and chat replies you request and show them in your history
• To verify purchases and manage your credit balance and subscription
• To keep the service secure and prevent abuse and fraud
• To respond to support requests and meet legal obligations

Legal bases: performance of a contract, legal obligation, legitimate interests (security and abuse prevention) and your consent for actions such as uploading photos.

5. Sharing and Service Providers

We do not sell your data. We share it only as needed to provide the service with the following providers:

Google services may process data on servers outside Türkiye; this transfer is necessary to provide the service. We may also share data with authorities where legally required.

6. Retention and Deletion

• Your data is kept for as long as your account is active.
• When you delete your account, your account, analyses, photos, chats, test results and credit history are deleted; the process, including copies in backups, is completed within 30 days.
• To prevent abuse, the device digest and the date starter credits were granted may be kept, unlinked from your account.
• Payment records are kept by Google Play (Android) or Apple (iOS) under their own policies.

7. Security

• All communication between the app and the server is encrypted with TLS (HTTPS).
• Session tokens are kept on your device in secure storage (Android Keystore / iOS Keychain).
• Access to the server and database is limited to authorised persons.

No system is 100% secure; in the event of a breach we will inform you and the relevant authorities as required by law.

8. Your Rights

Under KVKK Article 11 and the GDPR you have the right to know whether your data is processed, to request information and a copy, to rectification, to erasure, to object to processing, to data portability and to withdraw your consent.

Send your request from the email address registered to your account to aybuahdevefa@gmail.com. Requests are answered within 30 days. You also have the right to lodge a complaint with the Turkish Personal Data Protection Authority or the data protection authority in your country.

9. Age Requirement

Kinestos is not intended for anyone under 18 and we do not knowingly collect data from anyone under 18. If we learn that a person under 18 is using the app, we will delete the account and its data. You can report such cases to us.

10. Website and Cookies

The kinestos.com website has no accounts, no contact form, no analytics or advertising tools and uses no cookies. Only your language preference is kept in your browser's local storage (localStorage). The server keeps standard access logs (IP address, browser information, time) for security. Fonts are loaded from Google Fonts, which means your IP address is sent to Google.

11. Changes and Contact

We may update this policy when needed. The current version is always published on this page; we announce material changes in the app.
